DMCA Policy
American Airlines Flight Attendant ("we", "us", or "our") is committed to respecting the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the American Airlines Flight Attendant service or website (the "Site") if such claims are reported to our Designated Copyright Agent identified in the sample notice below.
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your work has been copied in a way that constitutes copyright infringement, please submit a DMCA Notice of Alleged Infringement to us using the information provided below. Upon receipt of a valid notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged content from the Site.
Filing a DMCA Notice of Alleged Infringement (DMCA Takedown Notice)
If you believe that your copyright protected work has been copied and posted on the American Airlines Flight Attendant Site in a way that constitutes copyright infringement, you must provide us with a written communication that includes substantially the following:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s) where the material is found).
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please note that any misrepresentations in your notice regarding whether content or activity is infringing may subject you to liability for damages (including costs and attorneys' fees).
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may send us a counter-notification. When we receive a valid counter-notification, we will forward it to the complaining party. If the complaining party does not file an action seeking a court order against you within 10-14 business days of receiving the counter-notification, we may restore the removed material.
A DMCA Counter-Notification must include substantially the following:
- Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL(s)) at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which American Airlines Flight Attendant may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature.
